May 19, 2003 Spain sues ABS in Prestige case The Prestige broke up off Spain last November, resulting in massive pollution, after the Spanish government refused it refuge. Spain claims that ABS was negligent in its inspection of the tanker's hull and structure and failed to detect and warn about corrosion, fatigue damage and other problems. The suit also alleges that ABS failed to withdraw classification from the Prestige when it knew or should have known that the ship was unfit to carry cargo safely. The suit reportedly claims actual damages to be determined at trial and unspecified punitive damages. ABS has issued a statement saying it "is aware that various legal proceedings related to its role as the classification society of record for the tanker Prestige have been or will be initiated in U.S. Courts. From the outset, ABS has adhered to a policy of full transparency with respect to its involvement in this casualty. Since the matter is now sub judice, ABS must reluctantly refrain from further public comment but looks forward to vigorously and successfully defending its actions and its reputation in the Courts against these unmerited allegations and preposterous claims." |
