Now Diamond Offshore challenges legality of moratorium

Diamond Offshore filed suit against Secretary of the Interior Ken Salazar and others in the administration on June 17 in the U.S. District Court for the Southern District of Texas. As in the case brought in New Orleans by Hornbeck Offshore and others, the suit is challenging the administration's post Deepwater Horizon moratorium on deepwater drilling on the grounds that is "arbitrary and capricious, an abuse of discretion and otherwise not in accordance with the law."

The Diamond Offshore suit also says that "By virtue of their actions, Defendants have violated Plaintiffs' rights under the

Fifth Amendment to the U.S. Constitution. That amendment provides that no person shall suffer a 'taking' of private property without due process of law or just compensation ... the actions of Defendants herein constitute a taking of Plaintiffs' contract rights without due process of law for which Plaintiffs seek non-monetary relief."
